PRISONER TRANSFER INFORMATION

GENERAL

To all United States citizens interested in transferring to the United States under the terms of the Council of Europe (COE) Convention on the transfer of sentenced persons.

The Chief of the Defender Services Division, Administrative Office of the U.S. Courts, has agreed that U.S. citizen prisoners who are considering transfer to the United States may write to that office for advice on their cases. Inquiries will normally be forwarded to a Federal Public or Community Defender for reply. It is suggested that the following information be included in your initial letter to that office:
  • Full name, date and place of birth;
  • Aliases;
  • Date of arrest;
  • Date offense was committed;
  • The precise charges on which you were convicted. (If for a narcotics violation, include the type and total quantity of the drug involved for which the foreign sentence was imposed);
  • The sentence imposed by the court;
  • All information of record regarding prior misdemeanor or felony convictions in the United States. This should include: the precise charge(s), date/place of arrest and conviction; sentence imposed, date released from and/or probation status at the time of commission of the offense in the sentencing COE country. Do not at this time list or include other foreign convictions, tribal court convictions, expunged convictions, or juvenile matters. Address your inquiry to:

  • Neither an inquiry nor a request for transfer will bind a prisoner to give final consent. However, once final consent is given and verified at the verification proceeding, the consent becomes irrevocable.
IMPORTANT: The U.S. Department of Justice informs us that the process must be started in Austria. The American prisoner must request the prison transfer by asking the warden of the prison to contact the appropriate Austrian authorities and/or writing directly to Austrian Ministry of Justice, Sektion IV, Museumstrasse 7, 1080 Vienna.

PLEASE NOTE: THE PROCEEDINGS FOR TRANSFER TO A PRISON IN THE UNITED STATES MAY TAKE UP TO ONE YEAR.
